The man had died on Monday in custody after his daughter had accused BJP MLA of Unnao, his brother and his accomplices of raping her in June, 2017. In its decision today, the Court has put the victim's father's cremation on hold as it will hear the matter on Thursday i.e. April 12, 2018.
Even the Supreme Court is also likely to hear next week a plea for CBI probe into the case. Allahabad High Court directed the investigation agency to arrest Sengar after it informed the bench that the MLA was detained but not arrested.
Acting on this information, the court directed the CBI to investigate the case strictly and consider the filing of an application for cancellation of bail granted to other accused in the rape case.

Mr Singh replied that three of the accused have been arrested, including the lawmaker's brother.
While the MLA was being grilled in Lucknow, another CBI team reached Unnao where it quizzed the rape victim's family members at a local hotel where they have been staying since the last few days.
An FIR was lodged against Sengar on Thursday under sections 363, 366, 376, 506 of the Indian Penal Code (IPC) and Protection of Children from Sexual Offences (POCSO) Act, and the case was handed over to the CBI.

The victim's father died in judicial custody nearly a week after he was reportedly thrashed by the MLA's brother and others. The first FIR pertains to the alleged rape of the girl in which Sengar and Shashi Singh have been named as accused.
The court went ahead with its blasting of the state's top legal consultant, saying: "The police was not ready to register an FIR of the minor rape victim".
In his letter addressed to the Chief Justice, Chaturvedi had demanded a court-monitored investigation into the case and also into the subsequent death of the survivor's father in judicial custody.
