Court documents show the driver accused of crashing into the ambulance in North Carolina on Sunday was extremely under the influence. Newnum said it appears that the crash further injured the child and left him with critical injuries.

Winston-Salem police were notified at about 6:05 p.m. that the toddler had died at Wake Forest Baptist Medical Center, police said. The ambulance had been driving for more than three hours, after picking up the boy and his mother in Wise. He emerged with life-threatening injuries after the ambulance rolled over onto its side.

Romero was charged with driving while intoxicated and driving without a license. The detainer will allow U.S. Immigration and Customs Enforcement Agents to take Romero into custody once he is released from local custody. He is now being detained at the Forsyth, North Carolina detention center.

Police said the Honda was traveling south on USA 52 at around 1 a.m. Sunday when it rammed into the side of the ambulance which was also going south. The Accord, driven by Jose Martin Duran Romero, 27, of Neston Drive, ran off the road, police said. The passenger, Andres Figueroa Leon, was charged with failing to render aid and give information. Both tried to flee the crash scene, Fox reported. A witness stopped one of the men from leaving while the other was quickly apprehended by police.

Federal authorities also put Romero under an immigration detainer. He was being held without bail after bail had been set and then revoked.
