Talwars Acquitted In Daughter Aarushi's Murder By Allahabad High Court

The Allahabad High Court today acquitted Aarushi's parents, Rajesh and Nupur Talwar, who had been among the accused in the case. Aarushi was found murdered in her bedroom in the flat in Jal Vayu Vihar On May 16, 2008.

The High Court pronounced its verdict on an appeal filed by the Aarushi's parents Dr Rajesh andNupur Talwar.

Pinaki Misra, another defence counsel, said the CBI court judgment was "absolutely perverse and the High Court has set it aside correctly".

The couple was now lodged in Dasna jail in Ghaziabad. "The CBI never seized any of the Talwars" dental equipment that it claimed was used to kill Aarushi.

It was believed that the justice was delayed as the key witnesses who were present at the party refused to identify Manu in the court for unidentified reasons. Interestingly, they were given life sentence by a CBI court because of lack of evidence. Her parents said they discovered her dead and called the police. The police found her with her throat slit and injuries on her head. When they challenged the verdict in the Allahabad High Court, they blamed the CBI for "shoddy investigation".

Six days after Aarushi's body was found, police suspected it to be a case of honour killing and her dentist parents, Rajesh Talwar and Nupur Talwar, came under the scanner.

Jail sources said the couple were likely to walk free tomorrow. Their domestic help Hemraj was nowhere to be found, making him the suspect, till the next day when he was found on the roof of the apartment building in Noida near Delhi.

Justices B.K. Narayana and Arvind Kumar Mishra said in their judgment that the circumstantial evidence provided by the Central Bureau of Investigation (CBI) was insufficient to prove that the Talwars were guilty, giving the couple, serving life terms awarded by a special court, the benefit of doubt.

Vijay Shanker, who was the CBI Director in 2008 when CBI took over the Aarushi-Hemraj double murder stated that "destruction of evidence started the moment the crime was committed and continued".

Rajesh Talwar underwent a narco- analysis test from February 15 to February 20, but even this did not yield any new information.

After a lot of criticism for reportedly shoddy investigation, the then Uttar Pradesh chief minister, Mayawati, handed the case over to the CBI on June 1, 2008.

On November 25, 2013, CBI judge Shyam Lal convicted the Talwars and held them guilty of both murders.
